2. HOSTING

The Site is hosted by OVH, a French simplified joint stock company with capital of 10,069,020 euros, entered in the Roubaix-Tourcoing Trade and Companies Register under no. 424 761 419 00045, whose registered office is at 2 rue Kellermann, 59100 Roubaix, France.


3. ACCESSING THE SITE AND CONTENT MODIFICATIONS

By accessing or using the Site, you acknowledge having been informed of these Terms of Use, you accept them and agree to comply with them. If you do not agree with these Terms of Use, Poiray asks you to immediately leave the Site.

Poiray reserves the right to refuse any user who does not comply with the Terms of Use, access to all or part of the Site.

Poiray is not bound at any time to provide continual access to the Site free of any malfunction. Malfunctions refer to any technical or IT problems, any problems related to the structure of the communications networks and any force majeure event. These malfunctions may also be related to maintenance. The Site user accepts that these potential problems may occur when connecting. Poiray may not be held liable for damage resulting from accessing and browsing the Site.

Poiray reserves the right to modify or correct at any time and without notice the Site content, whatever its nature.

Poiray reserves the right at its sole discretion and without prior notice to modify, delete or add clauses to the Terms of Use of the Site. It is therefore recommended that users regularly refer to the latest version of the Terms of Use. If you continue to use this Site after the modification of these Terms of Use, you are considered to have agreed to the revised Terms of Use.


4. INTELLECTUAL PROPERTY

Regarding national and international provisions concerning copyright, rights conferred by trademarks and, in general, intellectual property rights, the Site and its content (including the graphics, images, text, logos and formatting) are and will remain, even after downloading, the exclusive property of Poiray and/or the natural or legal persons who have granted the assignment and/or licences for use of these intellectual property rights.

Therefore, any reproduction of any element on the Site and/or of any content published on the Site must be authorised, except for the personal use of the copyist within a family circle, which is free of charge.

Any other use, copying, reproduction, communication to the public, dissemination, translation or adaptation, in whole or in part, of an element or content published on the Site, on any medium whatsoever and by any process whatsoever, is prohibited, unless agreed in writing by Poiray in advance.

Any unauthorised reproduction constitutes infringement punishable under Articles L335-2 et seq. of the French Intellectual Property Code.

6. CONFIDENTIALITY POLICY AND PERSONAL DATA PROTECTION

This privacy policy (the "Privacy Policy") is intended to inform you of how Poiray processes the personal information that you provide to it via the Site, in our stores or by any other means.

Poiray acknowledges the importance of protecting and securing your privacy and personal information and has drawn up this Privacy Policy in accordance with the strictest criteria concerning the protection of personal data and any applicable regulations.

Accordingly, Poiray complies with amended Law no. 78-17 of 6 January 1978 (the French Data Protection Act) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, known as "GDPR" (together referred to below as the "Applicable Regulations").

The Privacy Policy applies to all Site users and/or Poiray’s customers. Please read it carefully. If you do not agree with the terms of this Privacy Policy, please do not disclose any of your personal information and stop using the Site. At the time of providing your personal data, you must agree to its collection, storage and processing by Poiray under the terms and conditions of this Privacy Policy, by ticking the box provided for this purpose.

You also have the right to withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of the processing based on consent given before its withdrawal.

Poiray may update this Privacy Policy at any time and without notice, in particular due to regulatory changes. The new Privacy Policy will apply from the date it is published online on the Site.

6.1. Information collected by Poiray

Your information that may be collected and processed by Poiray includes:

- If you contact Poiray, a trace of this correspondence your identifying and contact information, such as name, gender, date of birth, address, email address, password and phone number, when creating an account on the Site or completing our form in one of our stores;

- may be retained;

- information related to visits to our stores and/or the Site and your use of our services.

6.2 Uses of information

Poiray uses the personal information that you provide in order to:

- create your account on the Site and give you access to this account;

- provide you with the information, products and/or services that you request or that may interest you, when you have given consent to be contacted for this purpose;

- inform you of any change made to the Site.

Poiray does not sell, rent or disclose your personal information to third parties other than companies belonging to its group or an administrative or judicial authority which has ordered it to do so.

6.3 Retention period

The personal data collected on the Site is retained for a limited period to the extent strictly necessary and proportional for pursuing the purposes identified in this Privacy Policy, i.e. for 3 years following the last connection to the Site and/or the last contact with Poiray.

6.4 Security

Poiray uses all appropriate security measures to protect your information in accordance with this Privacy Policy and GDPR requirements.

In particular, Poiray takes all necessary precautions regarding the nature of the personal data provided to it and the risks posed by its processing, so as to protect its security and in particular, prevent it from being distorted, damaged or accessed by unauthorised third parties.

6.5 Transfer of personal data

Poiray and/or its Affiliates (i.e. any entity or company controlling or controlled by Poiray, or under control with it, control being defined by Articles L.233-1 and L.233-3 of the French Commercial Code) do not transfer any personal data to a state that is not a member of the European Union or European Economic Area.

6.6 Violation of personal data

Poiray will inform you as soon as possible of any breach of your personal data likely to result in a high risk to your rights and freedoms, in accordance with Articles 33 and 34 of GDPR.

6.7 Subcontracting

Poiray shall use processors providing sufficient guarantees concerning the implementation of appropriate technical and organisational measures so that the processing of personal data meets GDPR requirements.

As appropriate, the personal data processed by a processor is governed by a contract entered into between this processor and Poiray and/or one of its affiliates (i.e. any entity or company controlling or controlled by the Company or under control with it, control being defined by Articles L.233-1 and L.233-3 of the French Commercial Code), in accordance with Article 28 of GDPR.

6.8 Cookies

A cookie is a data file stored on your computer or any other device when using it to visit the Site. Poiray uses cookies to find out which Site pages are visited and how often in order to make it more user-friendly and offer you customised and personalised services when you next visit the Site.

The appearance of a banner informs you that a cookie may be stored automatically on your browser when visiting the Site, as well as of its purpose, and the option to reject it and change the settings by clicking on the link "find out more and manage cookies".

You can configure your browser to accept all cookies, reject all cookies, and inform you when a cookie is created, how long it is active for and of its content, as well as to enable you to refuse its storage on your device and clear cookies periodically.

By accepting the cookies, you consent to the use of your personal information in connection with the technologies as set out in this Privacy Policy.

The cookies used by the Site are only linked to anonymous users and their computers. They do not provide any reference making it possible to deduce users' personal data.

Some cookies are used by third parties (e.g. Google) in order to send Poiray data about the effectiveness of its promotions. Under no circumstances do the cookies obtain any personal information enabling the identification of a specific user.

In any case, the cookies used on the Site are temporary with the sole aim of making subsequent transmission more efficient. No cookie used on the Site will be active for more than thirteen months.

The Site uses four types of cookies:

- Strictly necessary cookies: they enable Internet users to browse the Site and use functionalities such as the basket.

- Performance cookies: the Site uses Google Analytics’ cookies to quantify the number of users visiting the Site. These cookies make it possible to measure and analyse how Internet users browse the Site. This information allows the Company to continually improve its services and facilitate the buying process for Site users. - Advertising cookies: these cookies are used to display important advertisements to users. In addition, they limit the number of times that each user views an advertisement and helps the Company to measure the effectiveness of its advertising campaigns. By accepting these cookies, the user agrees to the Company downloading this type of cookie on to their device and making use of it when the user visits the Site in future.

The Site may contain links to other websites that have different privacy policies to that of the Company. In this sense, Poiray will not assume any liability for the content or practices of linked websites. The Company recommends that Site users review the privacy policies of all websites that they may access via the Site.

6.9. Rights

Under the Applicable Regulations, you have a right of access to, and right to rectification and erasure of your personal data.

Furthermore, you have the right to object to the processing of your personal data in certain circumstances, as well as the right to request the restriction of processing of the personal data performed by the Company.

Poiray shall process all requests as soon as possible.

You also have the right to lodge a complaint with the French Data Protection Authority (CNIL).


7. SETTLEMENT OF DISPUTES

If any one of the provisions of these Terms of Use and Privacy Policy is held to be invalid or unenforceable, in whole or in part, under current laws and regulations, it will be removed from these Terms of Use and Privacy Policy without affecting the validity and enforceability of all the other provisions.


8.APPLICABLE LAW – COMPETENT JURISDICTION

These Terms of Use of the Site and Privacy Policy are governed by French law.

Poiray and the user shall first try to find an amicable resolution to any disputes that may arise between them. If they cannot find any common ground, the courts within the jurisdiction in which Poiray International's registered office is located will be recognised as having exclusive jurisdiction and may under these conditions be referred the matter in order to find a solution to the dispute.
